BREWER, J.

Defendant was convicted of assault in the first degree, ORS 163.185, and attempted murder, ORS 163.115. He appealed, assigning error to, among other things, the trial court's imposition of consecutive sentences. This court affirmed his convictions but vacated his sentences and remanded the case to the trial court for resentencing. State v. Warren, 168 Or.App. 1, 7, 5 P.3d 1115
