A jury found Herbert Wayne Currington guilty of two counts of rape, two counts of incest, and two counts of cruelty to children. After Currington moved for a new trial, the court merged his convictions for rape and incest but refused to merge the convictions for cruelty to children into the ones for rape. In this appeal, Currington contends that the trial court erred by (1) depriving him of his confrontation right, (2) failing to merge his convictions...
