Werner Enterprises was sued after one of its trucks was involved in a chain-reaction accident on Interstate 80 in Dallas County, Iowa. Werner sought contribution by counterclaiming against the plaintiffs and cross-claiming against the other defendants. The plaintiffs voluntarily dismissed their case in Dallas County in order to pursue their claim in a federal court in Texas.
