It is undisputed in this case that appellee-plaintiff Gurjit Dhillon, then five feet five inches tall, sought elective cosmetic surgery to increase his height. Paid $40,000, to podiatrist George R. Vito, D.P.M., who performed a limb-lengthening procedure1 on both of Mr. Dhillon's legs and feet, which were perfectly normal before undergoing the procedure. The surgery left one of Mr. Dhillon's legs shorter than the other...
