¶ 1 Kintli was convicted of driving under the influence of alcohol ("DUI") per se in city court and appealed to the District Court. Kintli moved the District Court to suppress results of an Intoxilyzer 5000 test. The District Court denied her motion and Kintli, reserving her right to appeal, pled guilty to DUI per se.
