Defendant-Appellant, Hartford Insurance Company ("Hartford"), appeals the district court's award of summary judgment in favor of Plaintiff-Appellee, Ajax Building Corporation ("Ajax"), which had initiated suit for the use and benefit of St. Paul Insurance Company ("St.Paul").
