HARRISON, J. (Pro Tempore).

The plaintiff, Charles Rushing, appeals a judgment in favor of the defendants, St. Paul Fire & Marine Insurance Company ("St.Paul") and Giovanni Reid. The district court granted defendants' motion for summary judgment on the grounds that plaintiff's exclusive remedy was a claim for workers' compensation because he was injured in an accident while in the course of his employment. For the following reasons, we affirm.
