Defendant, Richard Alfonso Pinto-Roman, filed this motion to dismiss the indictment for unlawful reentry after deportation pursuant to 8 U.S.C. § 1326(a)(2), arguing that an untimely indictment violated his rights under the Speedy Trial Act (the "Act"), 18 U.S.C. § 3161(b).
