On June 6, 1999, Geoffrey Todd West was convicted of capital murder, a violation of § 13A-5-40(a)(2), Ala.Code 1975. The jury recommended by a vote of 10-2 that West be sentenced to death. On July 7, 1999, the trial court sentenced West to death. West appealed his sentence and conviction. On June 30, 2000, the Court of Criminal Appeals affirmed West's conviction and sentence. West v. State, 793 So.2d 870
