In 1996, Elwyn D. Graham entered a plea of guilty to capital murder and was sentenced to life imprisonment without parole. He subsequently filed a timely petition for postconviction relief pursuant to Criminal Procedure Rule 37.1 in the trial court seeking to vacate the judgment.
