In June 2001, he filed a complaint for declaratory judgment and injunctive relief in which he took issue with the legality of the creation of a "Family Court" in Cherokee County by a standing order of the chief judges of the superior and state courts and the presiding judge of the juvenile court of the Blue Ridge Judicial Circuit.
