PEOPLE of the State of Michigan, Plaintiff-Appellant, v. Benjamen Jason LYONS, Defendant-Appellee.

On order of the Court, the application for leave to appeal the June 3, 2004 order of the Court of Appeals is considered, and, pursuant to MCR 7.302(G)(1), in lieu of granting leave to appeal, we VACATE the Court of Appeals order and REMAND this case to the Court of Appeals for plenary consideration. Proceedings in the circuit court are STAYED until further order of the Court of Appeals.

We do not retain jurisdiction.
