This appeal was originally filed in the Supreme Court of Georgia, but a portion of the case was transferred to this Court on jurisdictional grounds. Cain v. State, 277 Ga. 309, 310(1), 588 S.E.2d 707 (2003). In its opinion, the Supreme Court summarized the statement of the case as follows:
