OPINION

Opinion by Justice BAIRD.

Appellant was charged by indictment with the offense of capital murder. A jury convicted appellant of the lesser included offense of murder. The jury assessed punishment at thirty-five years confinement in the Texas Department of Criminal Justice-Institutional Division and a fine of $10,000. On direct appeal, we affirmed the judgment of the trial court. Salazar v. State, No. 13-00-164-CR, 2003 WL 22310484,
