MEYERS, J., delivered the opinion of the Court in which KELLER, P.J., and PRICE, WOMACK, KEASLER, HERVEY, HOLCOMB and COCHRAN, J.J., joined.

Jaime Charles Nonn appeals from his conviction for capital murder. Tex. Penal Code § 19.03(2). Because the State chose not to seek the death penalty, the jury's finding of guilt resulted in a sentence of life in prison. The Court of Appeals upheld his conviction. Nonn v. State,
