BRINKEMA, District Judge.

Before the Court is the government's appeal of a magistrate judge's order. The defendant, Marcus Hazelton, plead guilty to possession of marijuana in violation of 21 U.S.C. § 844 on February 4, 2003. On April 21, 2003, the magistrate judge ordered that the defendant serve one year of pre-judgment probation pursuant to 18 U.S.C. § 3607.
