The defendants, Harbar Construction Company and Denney Barrow, appeal from the trial court's denial of their motion to compel arbitration. The issue presented for review is whether the parties' sales contract and limited warranty agreements were contracts "evidencing a transaction involving commerce" within the meaning of 9 U.S.C. § 2, a part of the Federal Arbitration Act, 9 U.S.C. § 1 et seq. ("the FAA").
