Opinion by Justice ROSS.

Samuel Dean Stitt was found guilty by a jury of interfering with public duties, pursuant to Tex. Pen.Code Ann. § 38.15 (Vernon 2003).1 The jury assessed his punishment at seventy-five days in jail and a $500.00 fine, and recommended he be placed on community supervision for one year.
