A jury convicted Appellant Jimmy Lawton Elmore of using real estate or a building or a room or other property as a gambling place, namely, a place used for the operation of gambling devices. The jury assessed his punishment at one year's confinement in jail, suspended for two years. The jury also assessed a fine. The trial court sentenced Appellant accordingly.
