This case ensues from a domestic dispute between the appellant, David Colburn, and his wife, Donna Colburn. On August 14, 2001, and on August 15, 2001, David caused physical injury to Donna, and he later was charged separately on both counts with committing domestic battering in the third degree under Ark.Code Ann. § 5-26-305 (Supp.2001).
