Defendant was charged with operating a vehicle while under the influence of intoxicating liquor, third offense (OUIL 3rd), M.C.L. § 257.625(1) and (8). Defendant moved to strike a prior conviction for operating a vehicle by a minor with a bodily alcohol content, M.C.L. § 257.625(6), that was used to enhance the OUIL charge.
