COOPER, District Judge.

This is an action under 46 U.S.C. §§ 31303, et seq. ("Ship Mortgage Act"), for a deficiency judgment. The plaintiff, Winston Knauss ("Knauss"), moves for summary judgment against the defendant, Solomon Dwek ("Dwek"), for payment of a deficiency judgment of $950,000 along with interest and costs. Dwek opposes the motion, and cross-moves for summary judgment dismissing the complaint on the sole ground...
