LIVAUDAIS, District Judge.

Following a jury verdict and judgment in favor of the defendants, plaintiffs, Oscar Rico ("Rico") and Jesse Davis ("Davis"), have filed a motion pursuant to F.R.Civ.P. 50 for judgment as a matter of law and/or for new trial pursuant to F.R.Civ.P. 59. (Rec.Doc. No. 115). Defendants, Karen Witherspoon ("Witherspoon") and American Family Insurance Group ("American Family"), oppose the motion.
