Story Bed & Breakfast, L.L.P. ("Story") filed a petition for declaratory judgment pursuant to Indiana Code section 34-14-1-1,1 seeking to preclude the Brown County Area Plan Commission ("Plan Commission") from enforcing land use restrictions imposed by the planned unit development ("PUD") district ordinance governing real property owned by Story.
