BORDEN, J.
Under our statutory scheme, a defendant becomes eligible for the death penalty if he is convicted of a capital felony for the "murder of two or more persons at the same time or in the course of a single transaction . . . ." General Statutes (Rev. to 1997) § 53a-54b (8), as amended by No. 98-126, § 1, of the 1998 Public Acts (P.A. 98-126).
