The issues to be briefed and argued shall be limited to (1) whether California has subject matter jurisdiction over crimes that occur outside of California, but are initiated here, is a matter to be determined by the trial court, not a jury, (2) whether there was sufficient evidence to confer subject matter jurisdiction on California under the test set forth in People v. Morante (1999) 20 Cal.4th 403
