At issue on this appeal is the propriety of Supreme Court's grant of summary judgment to defendant dismissing a complaint which alleged that plaintiff Jordan Adams (hereinafter plaintiff) suffered a serious injury (Insurance Law § 5102 [d]) in an August 15, 1998 auto accident.
