We grant appellee's motion for rehearing, deny the requested relief, but withdraw our opinion filed January 16, 2003, and substitute this opinion in its place.

Appellant, Beal Bank, S.S.B., appeals from a judgment on the jury's verdict in favor of appellee, Robert H. Schleider III, on his claim for fraud against Beal Bank and on Beal Bank's counterclaim for the full face value of a promissory note....
