This appeal arises from a decision by the Board of Immigration Appeals ("BIA" or "Board") to dismiss a motion by petitioner, Cornel Viorel Scorteanu ("Scorteanu"), to reopen deportation proceedings pursuant to section 242B(c)(3) of the Immigration and Nationality Act ("INA" or "Act"), 8 U.S.C. § 1252b(c)(3), alleging ineffective assistance of counsel.1
