Congress enacted the Americans with Disabilities Act, 42 U.S.C. §§ 12101-12213 (2000) (the ADA), with a view toward eliminating discrimination against persons with disabilities. That is a laudable policy-but so is the policy of the State of Maine, variously expressed in statutes, regulations, and judicial decisions, that constrains retailers against the profligate sale of alcoholic beverages to inebriates.
