Ordered that the judgment is reversed insofar as appealed from, on the law, that branch of the cross motion which was to dismiss the complaint insofar as asserted against the defendant John H. Tecklenburg is granted, the complaint is dismissed insofar as asserted against that defendant, with prejudice, and the order dated March 27, 2002, is modified accordingly...
