RUBIN, J.

The People challenge an order dismissing a Welfare and Institutions Code section 6601, subdivision (a) petition to declare real party in interest Daniel Vasquez, a sexually violent predator (SVP).1 They contend the trial court exceeded its jurisdiction in dismissing the petition. After review, we issue a writ of mandate directing the respondent court to vacate its prior order and to enter a new order with directions.
