Before the Court is a Motion by Defendants Hector Acosta Martinez and Joel Rivera Alejandro to Strike "Notice of Special Findings" from Third Superseding Indictment, to Bar the Government from Seeking the Death Penalty under the Third Superseding Indictment, and to Declare the Federal Death Penalty Act ("FDPA") Unconstitutional (Dkt. 548).
