CEREZO, District Judge.

This is an action brought by the widow and children of Mr. Juan N. Ortiz-Batista against defendants Hospital Auxilio Mutuo (Auxilio) and its insurer, American International Insurance Company of Puerto Rico, pursuant to the Emergency Medical Treatment and Active Labor Act (EMTALA) (42 U.S.C. § 1395dd), and Articles 1802 and 1803 of the Civil Code of Puerto Rico (31 L.P.R.A. § 5141 & 5142).1
