We granted Wayne C. Hooks ("Hooks") petition for certiorari from denial of his post-conviction relief ("PCR") and now reverse.

FACTS

Hooks was indicted for murder, accessory after the fact of murder, accessory after the fact of assault and battery with intent to kill, distribution of marijuana and distribution of marijuana within proximity to a school.
