Jana Dandova attempted to kill her former lover, Craig Schumacher, by shooting him. She was indicted for attempted murder1 and first-degree assault2.

At her trial, Dandova asked to have the jury instructed on the defense of heat of passion, a defense codified in AS 11.41.115(a) & (f). The trial judge concluded that Dandova was not entitled to raise this...
