SUSAN LARSEN, Justice.

Richard Lance McLaren was indicted for engaging in organized criminal activity by conspiring to commit the aggravated kidnaping of Joe and Margaret Ann Rowe. The State alleged that McLaren performed the overt act of abducting the Rowes in pursuance of the conspiracy.
