The State of Arkansas, appellant, appeals appellee Steven R. Pinell's sentence of ten years' probation for the crime of rape, a Class Y felony. The specific issue in this appeal is whether this court will extend Act 192 of 1993, codified at Ark. Code Ann. § 5-4-104, 5-4-301 (Repl.1997), and make it applicable to all Class Y felonies. As it now stands, Act 192 makes probation a sentencing option only for certain Class Y felony drug offenses...
