Charles Tufankjian (Tufankjian) sued Rockland Trust Company (Bank), alleging breach of contract (count 1); breach of the duty1 of good faith and fair dealing (count 2); fraud and misrepresentation (count 3); negligence (which was ultimately waived) (count 4); and a G. L. c. 93A violation (count 5). The Bank counterclaimed for the cost of a $3,500 appraisal.
