Vernon Ramer ("the worker") was employed as a log-skidder operator by Swift Lumber, Inc. ("the company"). On April 28, 2000, the worker was injured when the skidder he was operating lurched forward and the seat dislodged, causing his right knee to strike a metal plate under the dashboard of the skidder.
