Defendant, Tenet Healthcare System Memorial Medical Center, Inc., appeals a judgment whereby the trial court dismissed the claims of plaintiff's original petition, with prejudice, but preserved plaintiff's rights to go forward with a tort claim asserted in an amended petition. For the following reasons, we affirm.
