At issue in this appeal from the dismissal of a legal malpractice claim is whether the trial judge erroneously dismissed the appeal based on the incarcerated plaintiff's failure to appear for a hearing on certain exceptions. For the following reasons, the judgment dismissing the appeal with prejudice is set aside and the matter is remanded for further proceedings.
