ZIMMERMAN v. UNEMPLOYMENT COMPENSATION BD.

836 A.2d 1074 (2003)

Sandra ZIMMERMAN, Petitioner, v. UNEMPLOYMENT COMPENSATION BOARD OF REVIEW, Respondent.

Commonwealth Court of Pennsylvania.

Decided November 26, 2003.

Attorney(s) appearing for the Case

Thomas R. Davies, Lancaster, for petitioner.

Paul R. Jordan, Harrisburg, for respondent.

BEFORE: COLINS, President Judge, and SMITH-RIBNER, Judge, PELLEGRINI, Judge, FRIEDMAN, Judge, LEADBETTER, Judge, COHN, Judge, and LEAVITT, Judge.

OPINION BY Judge LEAVITT.

Sandra Zimmerman (Claimant) petitions for review of an adjudication of the Unemployment Compensation Board of Review (Board) that denied Claimant unemployment benefits. In doing so, the Board affirmed the Referee's determination that Claimant's failure to volunteer that she had signed a non-compete agreement with a previous employer was willful misconduct and, thus, rendered her ineligible to receive unemployment compensation benefits.
