Presiding Justice McDADE delivered the opinion of the court:

Defendant Stephen A. Howerton was charged in a 10-count indictment with the first degree murder of Dwight Vice (720 ILCS 5/9-1(a)(1), (a)(2) (West 2000)) and the attempted murder of Darrell Vice (720 ILCS 5/8-4(a), 9-1(a)(1) (West 2000)). Defendant filed a motion to suppress statements. The circuit court granted the motion, and the State appeals. We affirm.
