On April 9, 2003, Defendant Isidro Pacheco-Espinosa filed a Motion to Suppress Physical Evidence and Statements (Doc. No. 17). Defendant argues that any statements and physical evidence, including the confiscated marijuana, cannot be used as evidence in his criminal trial because they were taken or seized after his illegal detention and arrest.
