I. INTRODUCTION

This case is before the court on a Motion for Summary Judgment filed by Drs. Edward R. Teitel, David Drennen, and Chris Classen ("the Plaintiffs") on July 23, 2003 (Doc. # 28), and a Motion for Summary Judgment filed by Wal-Mart Stores, Inc. ("the Defendant" or "Wal-Mart") on July, 24 2003 (Doc. # 30).
