[¶ 1] Daniel Joseph Knowels appeals from a judgment of conviction entered upon a jury verdict finding him guilty of driving under the influence of alcohol under N.D.C.C. § 39-08-01. After the close of the State's case-in-chief, Knowels moved for a judgment of acquittal1 under N.D.R.Crim.P. 29, based on insufficient evidence.
