SWEENEY, J.

A criminal defendant cannot be put in jeopardy twice for the same offense. U.S. CONST. amend. V; WASH. CONST. art. I, § 9. And jeopardy attaches when a jury is selected and sworn. State v. Rich, 63 Wn.App. 743, 747, 821 P.2d 1269 (1992).
