Plaintiff commenced this action to recover $4,904.34 for medical services rendered to defendant on August 19, 1999 and subsequently moved for summary judgment. Defendant opposed the motion, claiming that his medical procedure was not completed due to inadequacies in plaintiff's equipment and that he had been forced to undergo a second procedure at another hospital.
