The Ninth Circuit reversed this court's denial of petitioner's motion to amend his habeas corpus petition to include a claim under the Administrative Procedures Act (APA) (docs.#24, 31). Accordingly, petitioner's motion to amend his habeas co petition (doc. # 17) is GRANTED, and the court will consider petitioner's habeas corpus petition as having been so amended.
